These terms should be read together with our Privacy Policy, Shipping Policy, Returns Policy and Petoody Clean Eats Guide.

Nothing in these Terms of Service excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

2. Using our website

You agree to use our website only for lawful purposes and in a way that does not interfere with the website, its security or its normal operation.

You must not:

  • copy, reproduce or use our website content without permission;
  • interfere with, damage or disrupt the website;
  • attempt to gain unauthorised access to the website, customer accounts or systems;
  • submit false, misleading or inaccurate information;
  • use the website for fraudulent or unlawful purposes; or
  • use our website content for commercial purposes without our written permission.

We may restrict, suspend or terminate access to the website if we reasonably believe these terms have been breached.

3. Website availability

We aim to keep our website available and running smoothly. However, we do not guarantee that the website will always be available, uninterrupted, secure or error-free.

From time to time, the website may be unavailable due to maintenance, technical issues, updates or circumstances outside our control.

4. Accounts

You may need to create an account to access some features of the website or to place an order.

When creating an account, you agree to provide information that is accurate, current and complete. You are responsible for keeping your login details secure and for any activity that occurs under your account.

If we reasonably believe that account information is false, incomplete, misleading or being used improperly, we may suspend or close the account.

5. Product Information

We aim to provide clear and accurate product information, including product descriptions, ingredients, images, size, price and availability.

However, product information may occasionally contain errors or may change without notice. Product images are provided as a guide only and packaging may vary from the images shown on the website.

Some product information is provided by manufacturers, suppliers or distributors. While we do our best to keep this information accurate and current, we cannot guarantee that all third-party product information is complete, current or error-free.

Manufacturers may change ingredients, packaging, sourcing, sizing or product details without telling us first. You should always check the product label, packaging and ingredients before feeding or using a product, especially if your pet has allergies, sensitivities or specific dietary needs.

6. Pet health, allergies and suitability

Information on our website is provided for general educational purposes only. It is not veterinary advice and should not replace advice from your veterinarian or qualified animal health professional.

Every pet is different. A product that suits one pet may not suit another. This is especially important for pets with allergies, sensitivities, medical conditions, weight concerns, digestive issues, dental issues, pregnancy, senior care needs, young animals or species-specific dietary requirements.

Before introducing a new treat, food, meal topper, chew, supplement-style product or toy, you should consider your pet’s individual needs and seek veterinary advice where appropriate.

You are responsible for checking that a product is suitable for your pet before purchase and before use.

If your pet has an adverse reaction to a product, stop using the product and seek veterinary advice.

7. Petoody ratings and Clean Eats Guide

Petoody may use product ratings, categories or descriptions such as Pure, Simple or Selective to help customers compare products based on ingredient simplicity, transparency and our internal review process.

These ratings are provided as a guide only. They are not veterinary advice, nutritional advice, a formal certification, a health claim or a guarantee that a product will suit every pet.

Our ratings are based on the product information available to us at the time of review. If a manufacturer changes a product’s ingredients, packaging or formulation, a rating may change.

For more information about how we classify products, please refer to our Petoody Clean Eats Guide.

8. Treats, food, toppers, chews and toys

Products sold by Petoody may include pet treats, food products, meal toppers, chews, toys and other pet-related items.

You should always follow the feeding instructions, safety directions and product warnings provided by the manufacturer.

Treats, toppers and chews should be fed in moderation and as part of an appropriate diet for your pet’s species, age, size and health needs.

Chews and toys should be selected carefully based on your pet’s size, chewing style and behaviour. No toy or chew is indestructible. Pets should be supervised while using toys, chews or enrichment products, and items should be removed if they become damaged, unsafe or small enough to swallow.

9. Orders

When you place an order through our website, you are making an offer to purchase the products in your order.

An order is not accepted by us until we confirm acceptance, process payment or dispatch the order.

We may refuse, cancel or limit an order where reasonably necessary, including where:

  • a product is unavailable;
  • there is an error in the product description, image, price or availability;
  • payment is not received or is reversed;
  • we suspect fraud or unauthorised payment activity;
  • delivery details are incomplete or incorrect;
  • the order appears to be for resale or commercial use;
  • the order cannot be fulfilled due to supplier, safety, recall or delivery issues; or
  • we are otherwise unable to fulfil the order.

If we cancel an order after payment has been received, we will provide a refund for the cancelled item or order.

10. Pricing and payment

All prices are listed in Australian dollars unless otherwise stated.

Prices may change without notice. The price payable for a product is the price shown at the time you place your order, subject to any correction of genuine errors.

We may offer sales, promotions, discount codes or special offers from time to time. These may be subject to additional conditions, expiry dates, minimum spends, product exclusions or other limits.

Discount codes must be applied before checkout and cannot be applied retrospectively unless we agree.

11. Errors

Despite our best efforts, errors may occasionally occur on the website. These may include errors in product descriptions, images, pricing, stock availability, promotions or shipping information.

If a product is listed at an incorrect price or with incorrect information due to a genuine error, we may cancel or refuse the order.

If this happens, we will contact you and, where payment has already been made, provide a refund for the affected item or order. We will not charge you a higher price for an existing order without your agreement.

12. Shipping and delivery

Shipping and delivery information, including delivery areas, timeframes, costs and conditions, is set out in our Shipping Policy.

Delivery timeframes are estimates only. While we do our best to dispatch and deliver orders promptly, delays may occur due to courier delays, public holidays, weather, high order volumes, supplier issues or other circumstances outside our control.

You are responsible for providing complete and accurate delivery information. We are not responsible for delays, failed deliveries or lost parcels caused by incorrect or incomplete delivery details provided by you.

Risk in the products passes to you once the order has been delivered to the delivery address provided, including where the parcel is left in accordance with an authority to leave or delivery instruction.

Please refer to our Shipping Policy for more information.

13. Returns, refunds and Australian Consumer Law

Our Returns Policy explains how we handle returns, refunds, exchanges and store credits.

Nothing in these Terms of Service or our Returns Policy excludes, restricts or modifies any rights you have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If a product does not meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

If you receive a product that is faulty, damaged, unsafe, incorrectly supplied, not as described or otherwise does not meet a consumer guarantee, please contact us as soon as possible so we can assess and resolve the issue.

14. Change-of-mind returns

Change-of-mind returns are separate from your rights under the Australian Consumer Law.

For hygiene, freshness and safety reasons, we may only accept change-of-mind returns where the product is unopened, unused, in original condition and returned within the timeframe set out in our Returns Policy.

We may refuse change-of-mind returns for opened food, treats, chews, toppers, hygiene-sensitive items, damaged items or products that are no longer in saleable condition, unless you are entitled to a remedy under the Australian Consumer Law.

Please refer to our Returns Policy for full details.

15. Damaged, faulty or incorrect products

If your order arrives damaged, faulty, incorrect or incomplete, please contact us as soon as possible with your order number and photos where relevant.

We may ask you to provide information or evidence to help us assess the issue, including photos of the product, packaging, batch number, expiry date or delivery packaging.

Where required by law, we will provide an appropriate remedy.

16. Recalls and product safety

If we become aware of a product recall, safety concern or withdrawal that affects a product we sell, we may contact affected customers where possible and take reasonable steps in line with supplier, manufacturer or regulatory guidance.

You should follow all product instructions, warnings and storage directions provided on the product packaging.

17. Intellectual property

All content on this website, including text, graphics, logos, branding, product descriptions, ratings, images, icons, layout, design and other material, is owned by Petoody or used with permission.

You must not copy, reproduce, modify, publish, distribute, sell or use our content without our prior written permission, except where permitted by law.

The Petoody name, branding, rating system and website content may not be used in a way that suggests a connection with Petoody unless we have agreed in writing.

18. Customer content, reviews and feedback

If you submit a product review, testimonial, comment, photo, suggestion or other content to us, you confirm that the content is accurate, lawful and does not infringe the rights of another person.

By submitting content to us, you allow us to use, display, reproduce, edit and share that content for business, marketing and website purposes, including on our website, social media and email marketing.

We may remove or refuse to publish content that we consider inappropriate, misleading, offensive, unlawful, spam-like or unrelated to the product or service.

19. Privacy

Your privacy is important to us.

Our Privacy Policy explains how we collect, use, store and disclose personal information. By using our website, creating an account or placing an order, you agree to the handling of your personal information in accordance with our Privacy Policy.

Please refer to our Privacy Policy for more information.

20. Third-party links

Our website may contain links to third-party websites, including manufacturer websites, social media platforms, payment providers or delivery services.

These links are provided for convenience only. We are not responsible for the content, accuracy, privacy practices, security or services of third-party websites.

Accessing third-party websites is at your own risk.

21. Limitation of liability

To the maximum extent permitted by law, Petoody is not liable for any loss, damage, cost or expense arising from your use of the website, reliance on website content, product misuse, delivery delays, website interruptions or circumstances outside our reasonable control.

Nothing in these terms limits your rights under the Australian Consumer Law or any other rights that cannot be excluded by law.

Where our liability cannot be excluded but can be limited, our liability is limited, to the extent permitted by law, to one or more of the following:

  • replacement of the product;
  • supply of an equivalent product;
  • repair of the product;
  • payment of the cost of replacing the product or acquiring an equivalent product; or
  • payment of the cost of having the product repaired.

22. Indemnity

You agree to be responsible for any loss, damage, cost or expense we suffer as a result of your breach of these Terms of Service, your misuse of the website, your unlawful conduct or your infringement of another person’s rights.

Your responsibility under this section will be reduced to the extent that we caused or contributed to the relevant loss or damage.

23. Changes to these terms

We may update these Terms of Service from time to time.

The current version will be published on our website. By continuing to use the website after the terms are updated, you agree to the updated terms.

24. Severability

If any part of these Terms of Service is found to be invalid, unlawful or unenforceable, that part will be treated as removed to the extent necessary. The remaining terms will continue to apply.
